As relações condominiais e o comportamento antissocial no condomínio edilício: uma análise doutrinária e jurisprudencial

Abstract

The present article aims to demonstrate, from doctrinal and jurisprudential analysis, the grounds that support the possibility of exclusion of the part-owner with antisocial behavior. This will be done from the exposition of the institutes inherent to the theme, based on the analysis of legislation, doctrine, and jurisprudence, going through the various existing understandings on the addressed matters and also on the specific aspects related to the exclusion of the anti-social condominium member. The way the doctrine differs on the subject will also be considered. Thus, it is concluded by the very exceptional but existing possibility of exclusion of the referred condominium member.
