Sentidos de "direito à educação" no município de Juiz de Fora: análise discursiva de uma ação civil pública

Abstract

The 1988 Constitution, by embracing the principles stated in the Social State and democratic regime model, conferred greater relevance on the right to education, systematizing it in its own section. Regarding to childhood education the Citizen Constitution innovated by recognizing it as an extension of the universal right to education. The research aimed to analyze discourses on the right to education in a legal dispute that took place in the city of Juiz de Fora, during the second decade of the century. For this, we start from the conceptual presuppositions of Discourse Analysis, of Franco-Brazilian matrix, in dialogue with questions of constitutional law. The research had as locus of observation an enunciative scene involving the collective action filed by the Public Defender's Office, the challenge by the City Hall and the court sentence in the first instance. The research revealed that, in the clash between the institutional actors in question, what was at stake was also a discursive scene, a dispute over meaning between the neoliberal and social welfare discourse about the right to education.
