Vozes do feminicídio: uma análise da produção acadêmica em Direito após a Lei nº 13.104/2015

Abstract

The study presented herein has as its scope the analysis of the power of influence and the construction of a saber that women do not have a scientific field in the Academy, specifically on the theme of femicide, a criminal figure emerged with the enactment of Law No. 13,104 / 2015. theoretical framework Pierre Bourdieu's theory on male domination and symbolic violence (1998), the approach promoted in this research classifies femicide as a social phenomenon, whose understanding cannot be given separately from the political, economic, and social environment in which occurs. For this reason, several data on femicide are brought to light, which materialize the problem of gender inequality and which guide which questions and revisions need to be developed, in order to find out what is the need for confronting the murder of women because of the feminine condition has suffered. Therefore, a bibliographic survey of articles published in journals was carried out, in order to observe who the authors are who write about femicide, that is, whether they are men or women, and what is the tone of the speech delivered. In this way, understanding that male domination and symbolic violence crosses several fields and is reinforced by the constant reproduction of the patriarchal order, both by agents and by the institutions of society, we seek to understand whether, even occupying more and more the field of Law, the women remain subject to the historical and invisible structures that subjugate them and prevent them from speaking out, even when dealing with exclusively female tutelage.
