| Resumo: | O delito de infanticídio é alvo de diversos dissensos doutrinários e jurisprudenciais que estão diretamente relacionados a escolha legislativa de adoção do critério fisiopsicológico para a configuração do delito. Dito isso, para além de possíveis críticas relacionadas a escolha realizada pelo legislador, o presente trabalhado pretende, através de análise doutrinária e jurisprudencial, verificar as divergências existentes a respeito da elementar “sob a influência do estado puerperal” e a consequente dificuldade de sua caracterização na prática, diante da tendência de se exigir a produção de laudo pericial médico apto de comprovar sua ocorrência. Dessa forma, com base em uma das formas de interpretação, tendo como fundamento os princípios constitucionais de presunção da inocência e do in dubio pro reo, pretende-se apresentar resolução prática para a insegurança existente a respeito do tema. |
| Abstract: | The crime of infanticide is the target os several doctrinal and jurisprudential disagreements that are directly related to the legislative choice of adoption oh the physiopsychological criterion for the configuration of the crime. That said, in addition to possible criticisms related to the choice made by the legislator, the presente work intends, through doctrinal and jurisprudential analysis, to verify the existing divergences regarding the elementary “under the influence of the puerperal state” and the consequent difficulty of this characterization in practice, given the tendency to demand the production of a medical expertreport capable of provind its occurrence. Thus, based on one of the forms of interpretation, based on the constitutional principles of presumptions of innocence and in dubio pro reo, it is intended to presente a praticial resolution to the existing insecurity on the subject. |
