Blockchain e proteção de dados pessoais: (in)compatibilidades diante dos princípios da LGPD

Abstract

This paper analyzed the application of blockchain technology in the context of data protection, especially in light of the principles established by the General Data Protection Law (LGPD). The research investigated the intrinsic characteristics of blockchain, such as immutability and decentralization, and their impacts on the enforcement of data subjects’ rights. Through a bibliographic review and principled analysis, it was identified that, although the technology offered advancements in terms of security and transparency, it also presented challenges regarding its compliance with other principles, such as data deletion and data quality. The study addressed regulatory implications, as well as possible solutions to reconcile blockchain with the requirements of the LGPD, highlighting the importance of the involvement of the National Data Protection Authority (ANPD) and the Judiciary in the interpretation of the rules. In conclusion, it was determined that although blockchain has brought advances to data protection, its adoption requires normative adjustments and technical solutions that ensure compliance with the principles of current legislation.
