| Resumo: | Partindo da crítica à pena prisão e de uma análise histórica das penas na legislação penal brasileira, a presente pesquisa visa investigar, em primeiro lugar, a eficácia da política nacional de penas alternativas, desde a introdução das penas alternativas na legislação brasileira em 1984 até a atualidade, em relação a função declarada destas penas de serem uma alternativa à prisão. Em segundo lugar, a pesquisa visa investigar a eficácia da Justiça Restaurativa, desde sua implementação no Brasil no início dos anos 2000 até o presente, em relação à sua função declarada de ser não apenas uma alternativa à prisão, mas também ao sistema de justiça criminal tradicional. |
| Abstract: | From the criticism of prison sentence and historical analysis of penalties in brazilian criminal law, this research aims to investigate, in the first place, the effectiveness of the national policy of alternative penalties, since the introduction of alternative penalties in Brazilian law to the nowadays, in relations to the declared function of these penalties as alternatives to imprisonment. In the second place, a research aims to investigate the effectiveness of Restorative Justice, since its implementation in Brazil in the early 2000s to the present, in relation to its declared function of being not only an alternative to imprisonment, but also to the traditional criminal justice system. |
