| Resumo: | Este trabalho analisa a relação entre direito e ideologia na tradição marxista, com ênfase na teoria de Evgeni Pachukanis. A pesquisa examina como Pachukanis relaciona a forma jurídica à forma mercadoria, argumentando que o direito não é um sistema neutro, mas sim um reflexo das trocas mercantis e um mecanismo de legitimação das relações capitalistas. Além de Pachukanis, são exploradas as contribuições de Piotr Stutchka, e György Lukács, cada um oferecendo uma perspectiva distinta sobre o papel do direito e da ideologia na reprodução das relações sociais. O estudo também aborda críticas contemporâneas à visão de Pachukanis, incluindo a possibilidade de o direito ser um espaço de disputa dentro da luta de classes, conforme sugerido por influências gramscianas. Conclui-se que o direito, longe de ser um instrumento técnico ou neutro, atua como um mecanismo ideológico fundamental para a manutenção da ordem capitalista. |
| Abstract: | This paper examines the relationship between law and ideology within the Marxist tradition, focusing on the theory of Evgeni Pachukanis. The research explores how Pachukanis connects the legal form to the commodity form, arguing that law is not a neutral system but rather a reflection of mercantile exchanges and a mechanism for legitimizing capitalist relations. In addition to Pachukanis, the contributions of Piotr Stutchka and György Lukács are analyzed, each offering a distinct perspective on the role of law and ideology in the reproduction of social relations. The study also discusses contemporary critiques of Pachukanis' view, including the possibility that law may serve as a battleground within the class struggle, as suggested by Gramscian influences. The paper concludes that law, far from being a mere technical or neutral instrument, functions as a fundamental ideological mechanism for maintaining the capitalist order. |
