Os desafios da implementação da nova lei de licitações n° 14.133 no tribunal regional federal do município de Juiz de Fora (MG)

Abstract

This study aimed to study the implementation of the new Public Procurement Law No. 14,133/2021 in the Federal Courts, focusing on the municipality of Juiz de Fora, Minas Gerais. The previous law, drafted in 1993, was outdated, indicating a need to modernize it in light of technological advances to increase transparency and accountability in public procurement processes. To address this issue, this research conducted a structured interview with the supervisor of the Juiz de Fora Public Procurement and Contracts Sub-Secretariat. The interview was conducted remotely via WhatsApp Web and subsequently transcribed. To achieve this research objective, a case study and documentary analysis of the materials available on the website of the Regional Federal Court of the 6th Region were also conducted. Therefore, this research is qualitative, descriptive, and exploratory. Among the study's main findings, it was found that the implementation of the new procurement law was supported by the legal sector, through document standardization. Furthermore, it was found that the National Public Procurement Portal (PNCP) had a significant impact on processes, as it demonstrated the resulting increase in transparency, an indicator of a trend toward greater social oversight. Another change is the need for a well-conducted Preliminary Technical Study, as the Supplier, being a national supplier, needs to fully understand the contracted object to avoid the risk of failure.
