| Resumo: | Este trabalho buscou analisar a impenhorabilidade atribuída ao bem de família pela Lei 8009/1990 e pelo Código Civil de 2002, colocando em perspectiva uma interpretação funcionalizada desse instituto, desse modo, o objetivo deste estudo será compreender o regime de proteção ao bem de família, os fundamentos por trás dele e a partir de uma interpretação funcionalizada, demonstrar os efeitos e objetivos sociais buscados pelo instituto. Para tanto, foi realizada uma análise da jurisprudência do Superior Tribunal de Justiça, da legislação brasileira e da bibliografia correlata, buscando se compreender o que seria a funcionalização do bem de família e se a atribuição de impenhorabilidade a estes bens têm resguardado os direitos essenciais por trás do instituto. |
| Abstract: | This paper sought to analyze the non-attachability granted to family assets by Law 8009/1990 and the 2002 Civil Code, considering a functionalized interpretation of this institution. Thus, the objective of this study is to understand the family asset protection regime and its underlying rationale. Based on a functionalized interpretation, it demonstrates the effects and social objectives pursued by this institution. To this end, an analysis of the case law of the Superior Court of Justice, Brazilian legislation, and related literature was conducted, seeking to understand the functionalization of family assets and whether the granting of non-attachability to these assets has protected the essential rights underlying the institution. |
